On October 20, 2026, Los Angeles County election officials stated in a federal court filing that the Registrar does not independently house citizenship-related information beyond the voter’s own attestation, and that California has not authorized use of the federal SAVE citizenship database for this election. The Registrar therefore has no direct access to federal citizenship data.

This admission came in response to a Justice Department lawsuit seeking to segregate mail ballots from more than 20,000 voters the DOJ identified as “likely noncitizens.” Federal officials had given California and LA County 48 hours to review a password-protected thumb drive containing the list or set the ballots aside pending verification. LA County declined to open the drive, citing security protocols, and refused to segregate the ballots. The DOJ then sued, arguing that once credible evidence of possible noncitizen voting is provided, officials cannot simply count the ballots.

The court filing quoted the Registrar’s position: it “does not independently house citizenship-related information beyond the voter attestation” and is not equipped or authorized to verify citizenship within the election period. California officials have maintained that federal law (NVRA) and state law rely on self-attestation under penalty of perjury, and that additional documentary proof of citizenship is not required. They have also disputed the accuracy of the DOJ list, with LA County reporting that a sample review showed roughly 40 percent listed a U.S. birthplace and many registrations were already canceled or inactive.

The dispute occurs against the backdrop of large-scale immigration and relatively lax enforcement in California. Under the previous administration, record border encounters led to millions of illegal entries, with a significant share reaching sanctuary jurisdictions such as California. Noncitizen voting is illegal under federal law, yet the system in California depends primarily on self-declaration. Days earlier, the DOJ charged 28 lawful permanent residents in California with illegal registration or voting as part of “Operation Protect the Vote,” with 11 arrested and about 34 illegal ballots alleged since 2020. Those cases were drawn from the same broader list of suspected noncitizens.

Critics argue that when officials acknowledge they have no independent verification mechanism, refuse to open a provided list, and decline to segregate ballots while federal prosecutors have already brought charges, the practical effect is to shift the burden of protecting the citizenship requirement onto the courts and the DOJ. Supporters of the state’s position say the list’s methodology is unproven and that segregating ballots so close to the November 3 election risks disenfranchising citizens. The federal court will now decide whether to order the ballots set aside pending verification.
