The Department of Homeland Security finalized a rule today that ends the practice of automatically extending employment authorization documents for up to 540 days while renewal applications are pending. The final rule is effective October 14, 2026. It reaffirms and finalizes the interim final rule published on October 30, 2025. Ending the automatic extension enhances benefit integrity and prioritizes the proper vetting and screening of aliens before granting a new period of employment authorization and a new EAD.

Renewal applications filed before October 30, 2025, remain eligible for the up-to-540-day automatic extension. Applications filed on or after that date do not receive an automatic extension of the expired or expiring document or employment authorization, unless otherwise provided by law or through a Federal Register notice for Temporary Protected Status-related employment documentation. Applicants must be properly screened before they receive a new work permit. Renewals can take months. If the case fails and status is lost, removal follows.

The Biden administration expanded the automatic extension to 540 days in its final weeks in office, to prevent employment interruptions caused by processing backlogs. Eric Daugherty posted the news at 8:54 a.m. PDT. He wrote that the migrant either stays here with no work or self-deports, and that if the case fails and status is lost, forced removal follows. Those lines are his. The rule itself is the end of the automatic extension and the requirement of proper screening before a new permit.

DHS estimates that between 20,000 and 33,000 work permits could lapse during an 18-month period beginning in May 2027, potentially affecting 1,700 to 2,800 employers. The midpoint estimate is approximately 27,000. A work permit is not a right that continues while the government is still checking. It is a permission that ends when the document ends, until the check is finished.
