On October 19, 2026, the U.S. Department of Justice announced that federal agents had charged 28 foreign nationals in California with illegally registering to vote or casting ballots in federal elections. Eleven of them were arrested that morning as part of “Operation Protect the Vote.” All 28 are lawful permanent residents (green card holders) but not U.S. citizens, and therefore ineligible to vote in federal elections.
The charges include making false statements on naturalization applications (falsely claiming U.S. citizenship to register or vote) and fraudulent voter registration. Both are felonies carrying up to five years in prison. Prosecutors said 21 of the 28 are suspected of actually casting ballots, some in multiple elections. In total, the group is accused of casting about 34 illegal ballots since 2020. One 72-year-old Belizean national in Commerce, Los Angeles County, is accused of voting illegally in four elections after registering in 2019 by falsely claiming citizenship.
The 28 names appear on a list of more than 20,000 “likely noncitizens” that the Justice Department sent to California election officials last week. California officials had refused to review the list or set aside the corresponding mail-in ballots pending citizenship verification. Acting Deputy Attorney General Trent McCotter said the arrests confirm that noncitizens are voting in California elections and that the state’s refusal puts lawful votes at risk. LA’s top federal prosecutor Bill Essayli stated: “Today’s arrests confirm what we suspected and what we put California on notice for: Noncitizens are voting in California elections which is unconstitutional and illegal.”
The action comes days after the Justice Department sued California over its mail-in voting system and issued an ultimatum regarding the 20,000-name list. Earlier, the administration had alleged that California’s voter rolls might contain as many as 190,000 noncitizens. California officials have disputed the broader claims, citing lack of evidence and concerns about disenfranchising legitimate voters. Over the past seven weeks, the Justice Department said it has charged 113 people with similar voting-related crimes in 20 states.

President Trump shared the New York Post report on Truth Social the same day, highlighting the arrests as part of efforts to protect election integrity ahead of the November 3 midterms.
