President Trump put two records in front of the public on October 6. One is a watchdog report on visa overstays. The other is a headline: Jack Smith spied on a Trump staffer’s communications and more than 20 lawyers. The first is a search that was ordered not to happen. The second is a search that reached the defense.

A nonimmigrant visa is a temporary permission, with an end date. Stay past it, file nothing, and the person is an overstay. Removal does not happen by itself. In September 2021 the department told investigators to open only Priority 1 leads, the highest threat to national security or public safety. From fiscal 2021 to 2024 the inspector general counted 3,145,375 overstays. Of those, 104,049 were flagged as security or safety concerns. ICE opened 496 investigations and arrested eight. Of 1,769 viable Priority 1 leads, 84 were opened and two people were arrested. The other 3,041,326, 96.7 percent, were marked non-priority and left there.

The same years, special counsel Jack Smith was investigating classified documents at Mar-a-Lago. Declassified memos released October 5 say his team, in a probe codenamed Plasmic Echo, put a pen register on Susie Wiles’s phone from about February to May 2023. The log recorded who called, when, and for how long. It reached at least 21 lawyers affiliated with Trump, campaign staff, and at least five journalists. House Judiciary Chairman Jim Jordan said that net may have touched attorney-client privilege, and renewed his call to pursue Smith for lying to Congress. The word “spied” is the headline’s. The paper shows the calls of the defense being logged.

One pen, two directions. The overstay list was the security job. It was narrowed until eight arrests stood for 104,000 flagged names. The lawyers’ calls were not that job. They were logged anyway, in an election year. What was written up as national security was not pursued. What was written up as a case reached the opponent’s defense and campaign. The people under the rule carried it out. The ones who objected did not hold the pen.
