The U.S. Department of the Treasury and the Internal Revenue Service issued proposed regulations today to implement President Trump’s Working Families Tax Cuts reforms to the Premium Tax Credit. The Premium Tax Credit is a refundable tax credit that helps eligible American taxpayers afford health insurance purchased through the Health Insurance Exchanges. Treasury Secretary Scott Bessent said hardworking American taxpayers should not be forced to subsidize health care for people who are ineligible under federal law.

The proposed rules do three things. Beginning in 2027, they ensure taxpayer-funded health insurance subsidies go only to Americans who qualify under federal law. They restrict Premium Tax Credit eligibility to U.S. citizens, U.S. nationals, and certain lawfully present noncitizens. They apply commonsense eligibility checks and add new verification criteria for any advance payments of the credit. Bessent said the rules implement the common-sense reforms enacted by the Working Families Tax Cuts to close eligibility loopholes and ensure taxpayer-funded Premium Tax Credits are reserved for eligible Americans. Under President Trump, this Administration is cracking down on fraud and corruption, holding bad actors accountable, lowering health care costs for Americans, and restoring integrity to the tax code and health care system.

He wrote that the move abolishes taxpayer-funded Obamacare subsidies for people who are not eligible under federal law, such as foreign “refugees.” The phrase “foreign refugees” is his example. The Treasury rule itself says eligibility is restricted to U.S. citizens, U.S. nationals, and certain lawfully present noncitizens. The rules are proposed. They take effect beginning in 2027.

The post also noted that CMS had earlier removed more than 760,000 unverified “phantom” Obamacare enrollees, saving an estimated $2.2 billion. Vice President Vance said in September that the administration was halting enrollment for more than 760,000 people believed to have been fraudulently signed up. That action is separate. Today CMS also announced it is cutting off subsidies for about 189,000 people identified as having duplicate government coverage or being deceased, an action officials estimate will save roughly $738 million this year.

The subsidies were for people the law said were eligible. The proposed rules say the law’s line will be drawn where the statute draws it. A taxpayer who works for the money does not owe a subsidy to a person the statute says is not eligible to receive it.
