President Trump posted on Truth Social today: “They will all go to jail for a long period of time!!!” He quoted a report by Matt Finn: in a new letter to LA County, the Department of Justice warns that if the County allows ballot processors to tabulate the votes of alleged non-citizens, they are opening themselves to federal criminal prosecution. The letter states that if persons knowingly tabulate ballots cast by individuals identified by federal agencies as noncitizens, they risk becoming aiders and abettors to a federal crime.

The Department of Justice letter, dated October 16, 2026, and signed by Acting Deputy Attorney General Trent McCotter, is addressed to Peter M. Bollinger, Assistant County Counsel for Los Angeles County. It states that on October 13 the Department hand-delivered a password-protected dataset identifying more than 20,000 individuals whom federal agencies reasonably believe are likely noncitizens registered to vote in California. The list was developed through multilayered investigative methodology using internal immigration records, data matching, supervisory verification, and more. Noncitizen voting in a federal election is a federal crime, and knowingly facilitating it is equally unlawful under 18 U.S.C. § 611.

The letter says California’s self-attestation registration system does not relieve election officials of their obligations under federal law once they have actual notice of noncitizen voting. State procedures cannot supersede federal criminal statutes. The Department has not asked the County to adjudicate immigration status; it has asked the County to temporarily set aside ballots from individuals whose eligibility is credibly in question—a standard election-administration practice. The letter strongly urges the County and the California Secretary of State to reconsider their positions before taking actions that risk significant federal scrutiny and legal exposure.

Eric Daugherty and other accounts circulated Trump’s post and the DOJ letter on X. Daugherty wrote that officials must sequester the ballots and verify citizenship, or they are “cooked,” and called them election crooks. Those lines are his. The DOJ letter and Trump’s statement are the documents.

Whether the County sets the ballots aside, and whether any official is later charged, will be decided by what the County does next and by what the Department of Justice does with the notice it already gave.
