Foreign-born judges keep trying to rule America!” He quoted the order: “The defendant shall open the registration period for the fiscal year 2027 diversity visa program by midnight October 18th, that is Sunday, and the registration period shall last for 30 days.” He added that the administration suspended the lottery last December after a Portuguese national who got his visa through it was suspected of killing four people in two shootings in Rhode Island and Massachusetts, and that a random lottery for green cards makes no sense and should end.

The judge is U.S. District Judge Jinsook Ohta of the Southern District of California, a Biden appointee. On October 14 she issued a preliminary injunction in Red Eagle Law LC v. Rubio, No. 3:26-cv-04738. The order requires the State Department to announce and open a thirty-day registration period for the fiscal year 2027 Diversity Visa Program by midnight Eastern time October 18, 2026, accept qualifying electronic entries, notify selectees by midnight November 19, and process applications under existing rules until the 2027 allocation is used or September 30, 2027, whichever comes first. She found the failure to open registration was likely “arbitrary and capricious.” She had earlier denied a temporary restraining order. The injunction is preliminary. The government can appeal.

The program itself was created by Congress in the 1990 Immigration Act. It gives about 55,000 immigrant visas a year by random draw to people born in countries that have sent relatively few immigrants to the United States in recent years. It is not based on skills, family ties, investment, or refugee status. Applicants register online during a fixed window. Those selected must still pass background checks, interviews, and document review before a visa is issued. The first formal lottery was for fiscal year 1995.

In December 2025 the Trump administration paused it. Portuguese national Claudio Manuel Neves Valente, who received a diversity visa in 2017 and later a green card, was identified as the suspect in the Brown University and MIT shootings. Two students were killed and nine wounded at Brown; an MIT professor was killed. Valente was later found dead by suicide. Homeland Security Secretary Kristi Noem said at the President’s direction she was pausing the program “to ensure no more Americans are harmed by this disastrous program.” The State Department later paused issuance of diversity visas while it reviewed screening and vetting. The 2027 registration window was not opened on the normal schedule.

The pause began because a person who entered through the program was linked to multiple killings. The injunction treats the failure to open the next registration window as an administrative action that needs a fuller explanation under existing law. Daugherty’s lines about the judge having to go, foreign-born judges ruling America, and taking in zero foreigners on diversity are his. The order requires a registration window, not the automatic issuance of 55,000 green cards. Whether the program continues, is reformed, or is ended is ultimately a question for Congress or for a final court decision after appeal.
