CBS: U.S. Surrogate Carried Child for Chinese Billionaire Xu Bo — Birthright Citizenship Loophole Back in Focus

At about 9:50 a.m. Pacific Time on September 13, commentator Eric Daugherty circulated that day’s CBS investigation: an American surrogate believed she was carrying a child for a “single father.” The intended parent was Chinese gaming billionaire Xu Bo. He has been reported to have fathered more than 100 children through U.S. surrogates, who receive citizenship at birth.

CBS当天说明：泄露文件点出委托方是徐波；前伴侣在抚养权官司中称孩子可能多达300个；徐波方面否认上述数字，称他在美国代孕所生、现有监护权的是12个。CBS采访了化名“Judy”的代孕妈妈，她说事先不知道对方家庭规模。CBS称共访谈32名代孕者，胚胎移植多在加州完成。
CBS said leaked documents named Xu Bo; a former partner in a custody fight claimed the number could reach 300. Xu’s side disputed those figures and said he has custody of 12 children born through U.S. surrogacy. CBS interviewed the surrogate, called “Judy,” who said she did not know the scale of the family. CBS said it spoke with 32 surrogates; most embryo transfers were done in California.
此事并非全新。2025年12月《华尔街日报》已写：洛杉矶家事法庭发现同一中国富豪反复申请亲权；2023年夏季，徐波人在中国、视频出庭，据与会者转述，他希望通过代孕在美生大约20个孩子、偏好男孩，以便日后接班。若干孩子当时由尔湾一带保姆照看，等手续回中国，他本人尚未见面。公司一度在微博口径承认“一百出头”，后又强调美国出生的只有12个。徐波近日还发出上百名孩童并排而坐的照片，并称“多子多福”，希望言行“有利于中华民族长远发展”。
This is not new. In December 2025, The Wall Street Journal reported that a Los Angeles family court saw the same Chinese billionaire filing parentage petitions again and again. In summer 2023, Xu appeared by video from China. People at the hearing said he hoped for about 20 U.S.-born children through surrogacy, preferring boys to take over the business. Some children were then with nannies in Irvine, waiting for papers to go to China; he had not yet met them. His company once said he had “a little over 100” children, then stressed that only 12 were U.S.-born. Xu recently posted a photo of about a hundred children seated in rows and said “more children, more blessings,” hoping his words and deeds would “benefit the long-term development of the Chinese nation.”

在美国出生即获护照，是制度本身给出去的，不取决于这些孩子现在会不会投票。
U.S. birth confers a passport under the current rule. That does not depend on whether these children can vote today.
多尔蒂把这条接到出生公民权上：对手在钻空子；国会应立法，不能只靠行政令去堵。六四天网认为，这一层才是正题。
Daugherty tied the story to birthright citizenship: adversaries are working the loophole; Congress should pass a law, not leave the gap to executive orders alone. 64tianwang holds that this is the real issue.

America’s system leaves wide room for speech, birth, and contract — and therefore leaves openings for hostile states and individuals. Surrogacy can be a family choice. Turning it into cross-border mass production of citizenship, then pairing it with talk of serving another nation’s long-term rise, is not a private matter. It is a national one.
出生公民权写进宪法第十四修正案，本意是承认在这块土地上出生、并受美国管辖的人。它不是一张无限次的空白支票，更不是给境外资本批量订做下一代选民和护照持有人的生产线。漏洞不堵，吃亏的是守法纳税、真正把孩子当美国人养的家庭；得利的是把美国当户籍工厂的人。
Birthright citizenship is in the Fourteenth Amendment. It was meant to recognize those born on this soil and subject to U.S. jurisdiction. It is not a blank check, and it is not a factory line for foreign capital to order the next generation of voters and passport holders. Leave the hole open, and law-abiding families who raise Americans pay the cost. Those who treat the United States as a citizenship mill collect the gain.
川普总统一直把出生公民权、边境和国籍当作立国根基来谈，不是口号。根基松了，投票权、福利、安全审查都会跟着松。国会该把话说死：谁在利用代孕和落地即公民，规则就必须改。能辨，才谈得上守住这个国家。
President Trump has treated birthright citizenship, the border, and nationality as foundations of the country, not slogans. If the foundation loosens, voting, benefits, and security screening loosen with it. Congress should say it plainly: if surrogacy and citizenship-at-birth are being used this way, the rule must change. Only with that distinction can the country be held.
