On Friday, Secretary of State Marco Rubio announced sanctions on the International Criminal Court. “Either the ICC will end its threats, or we will end the ICC.” President Trump, he said, will never allow the court to prosecute Americans. The United States will ban transactions with the court, cut off its resources, and cripple its ability to operate. The Treasury set a six-month grace period. Telecoms, software, pensions, and transactions tied to detainees are exempt for now.

The United States never joined the Rome Statute. Neither did Israel. A court a nation did not join has no jurisdiction over its citizens, its soldiers, or its elected leaders. Rubio named what the court wants next: American service members, Border Patrol agents protecting the border, and the elected officials securing the country. Unelected judges an ocean away do not get that power. Sovereignty is not a courtesy the court extends. It is the line.

Japanese Prime Minister Sanae Takaichi wrote separately that the decision is incompatible with Japan’s position, and that Tokyo will keep talking to Washington. Allies may disagree. Disagreement does not put American soldiers in a dock in The Hague.
