DHS Puts Sanctuary Judges on Notice After Massachusetts Judge Let Detainee Slip ICE

At 12:25 p.m. Pacific Time on September 14, the Department of Homeland Security posted a statement from General Counsel James Percival: some judges treat their duty as undermining federal immigration law rather than enforcing it; helping illegal aliens escape immigration officers is a felony; sanctuary politicians and sanctuary judges alike are on notice.

The case is Judge Shelley Joseph of Newton, Massachusetts. On April 2, 2018, she heard Dominican national Oscar Manuel Peguero, also known as Jose Medina-Perez, who was in the country illegally. He had been arrested for possession of Class B and Class E drugs and had a fugitive warrant in Pennsylvania. ICE lodged a detainer on March 30; it was not honored. An ICE officer waited outside the courtroom. Joseph let Peguero leave through a back exit and told the clerk to shut off the courtroom audio.

In 2019, during President Trump’s first term, federal prosecutors charged Joseph. After Biden took office, the case was dropped in 2022. The state then used judicial discipline. On September 10, 2026, the Massachusetts Supreme Judicial Court issued a public reprimand, finding she created an appearance of impropriety and violated her duties. She was not removed. She was not jailed.

Reuters reported that a hearing officer found the commission had not proved she knew of a plan to help the man evade ICE, so the commission later asked only for a public reprimand. The high court adopted that 6–0. The court still held that her off-the-record talk with counsel, her suggestion of holding him overnight in state custody after learning ICE was present, and the order to cut the audio were enough for a reprimand.

法官是守住一个国家和社会公平正义、守住社区安全底线的最后防线。法庭不是庇护所，后门不是移民法的例外条款。联邦探员依法等在门口，州法官用自己的法庭把门绕开，录音再关上一道，社区看到的就不是中立裁判，而是执法被拆台。
A judge is the last line that holds justice and community safety. A courtroom is not a sanctuary. A back door is not an exception to immigration law. When a federal officer waits at the front as the law requires, and a state judge sends the man out the rear and kills the tape, the public does not see a neutral bench. It sees enforcement undone.
这道防线若松了，毁的不只是一桩案子，是整个国家和社会的安全与尊严。州高院承认不当，却只训诫了事；DHS把话说到全国：帮助躲避ICE，在联邦法上可以是重罪。川普政府要的是法律被执行，不是法官用程序把人送出大门。能辨公私，才谈得上法庭还站在人民一边。
If that line fails, what breaks is not one case. It is the country’s safety and dignity. The state high court admitted misconduct and stopped at a reprimand. DHS said it to the whole country: helping someone evade ICE can be a federal felony. The Trump administration wants the law enforced, not a judge walking a detainee out the side door. Only if public and private are kept apart does the court still stand with the people.
