Supreme Court Blocks Trump USPS Mail-Ballot Rule; Alito and Thomas Dissent

On the afternoon of September 14, Pacific Time, the U.S. Supreme Court denied the Trump administration’s emergency application and left in place Boston Judge Indira Talwani’s injunction: before this midterm, the Postal Service may not force through its new mail-ballot rule. The unsigned order said the government is unlikely to succeed on the merits.

Justice Kavanaugh concurred: even if USPS might have power to write the rule, state and local election officials do not have time to implement it reasonably before the election. Justice Alito dissented, joined by Justice Thomas. Alito wrote that Congress may authorize the Postal Service to make such rules; the government met the showing for a stay; the challengers were throwing a “Hail Mary pass.”

The rule followed President Trump’s March directive. States would give USPS lists of mail-ballot recipients; ballots would need designated envelopes with an election logo, high-speed scanning, and a unique voter barcode. No match, no send or no return. The government called it an anti-fraud, traceability measure. California and civic groups sued, saying it would scramble ballots already in the mail before November 3. North Carolina and Alabama had already started mailing.

Commentator Nick Sortor posted about 4:44 p.m. Pacific: the Court blocked the restrictions Trump wanted USPS to run; Alito and Thomas dissented. He read the order as forcing ballots to non-citizens. The order does not say that. What it blocks is using the list-and-barcode rule before the midterms. The case can continue. This election cycle will not see the rule.

这是一道愚蠢的裁决。不是因为信封上的油墨,是因为时间被做成挡箭牌:规则要核名单、要可追踪,法院就说“来不及”,于是漏洞照开到投票日。成年公民的选票是这个国家的主权。邮寄选票一旦不核收件人、不留条码,就变成一张谁都能往信箱里塞的空白纸。川普政府要做的,是让邮局只给名单上的人送信,不是取消投票。
This is a foolish ruling. Not because of ink on an envelope, but because time was used as a shield: the moment a rule requires a list and a barcode, the Court says there is “not enough time,” and the hole stays open through Election Day. An adult citizen’s ballot is the country’s sovereignty. Mail ballots with no name check and no barcode become blank paper anyone can drop in a box. The Trump administration asked the Postal Service to deliver only to people on the list. It did not ask to cancel voting.

Alito and Thomas said it in dissent: Congress already gave USPS power over envelopes and addressees. The majority pinned that power with “not enough time,” which tells the states: crowd the calendar against Election Day, and a federal anti-fraud rule cannot enter. After November 3 the same hole can open again. Only if “easy to mail” is kept apart from “who may vote” does a republic still exist. Call verification a disaster and the loophole a right, and the people who pay taxes and show up to vote are the ones who pay.
